It will enter into force 14 December 2012 Regulation (EU) No 432/2012 of 16 May 2012, which aims aim to provide for each ingredient used in the composition of food products, including dietary supplements, therefore, a single claim at European level one instruction that is on the properties of the ingredient, excluding the possibility (this date) indications differ depending on the country of production. A similar process, with the same objectives cover cosmetic products (category which also includes creams) and will enter into force in July 2013.

COMMISSION REGULATION (EU) No 432/2012 OF THE COMMISSION of 16 May 2012on the compilation of a list of permitted health claims made on foods, other than those referring to the reduction of disease risk and to children's development and health

THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EC) n. 1924/2006 of the European Parliament and of the Council of 20 December 2006 on nutrition and health claims made on foods (1), and in particular Article 13, paragraph 3, Whereas: (1) Pursuant to the provisions of Article 10, paragraph 1 of Regulation (EC) n. 1924/2006, the health claims made on food are prohibited unless they are authorized by the Commission pursuant to the regulation

Article 20, paragraph 1 of Regulation (EC) n. 1924/2006 provides that the Commission shall establish and keep updated a register of EU nutrition and health claims made on foods (hereinafter 'the Register'). The register will include all the information that must be, and the conditions of employment applicable to them. It will also contain a list of rejected health claims and the reason for rejection.

One of the objectives of Regulation (EC) n. 1924/2006 is to ensure that health claims are truthful, clear, reliable and useful to the consumer. In this respect it is necessary to take into account for the formulation and presentation of health claims. Where the formulation of an indication to the consumer has the same meaning of a health permitted, as it demonstrates the existence of the same relationship between a food category, a food or one of its components, on the one hand, and health, on the other hand, that statement must comply with the conditions of use are identical to those established for the permitted health claims.


The date of application of this Regulation shall be six months after the date of its entry into force in order to enable food business operators to comply with its provisions, including the prohibition under Article 10, paragraph 1 of Regulation (EC) no. 1924/2006, those health claims which have been completed evaluation by the Authority and the examination by the Commission.

This Regulation shall enter into force on the twentieth day following its publication in the Official Journal of the European Union. It shall apply with effect from 14 December 2012.
